Senator Mike Lee of Utah has introduced the Achieving Choice in Education (ACE) Act, aimed at expanding educational options for American families. The bill addresses concerns about ideological influences in public education and seeks to reduce economic barriers to alternative schooling. Senator Ted Budd from North Carolina is a co-sponsor, while Representative Eric Burlison of Missouri has introduced the legislation in the House.
"It is the fundamental right of parents to choose the educational path that is most suitable for their children," stated Sen. Lee. "The ACE Act ensures that our tax system reflects this principle and provides real support to those seeking alternatives to public schooling."
Senator Budd, who has homeschooled his three children, expressed his support: “I’m proud to cosponsor the ACE Act, which will give more parents the option to choose the education that is best for their children.”
Representative Burlison highlighted existing benefits of school choice: “Across the country, and especially in Southwest Missouri, school choice is already benefitting many of our nation’s young children.”
The ACE Act builds on a provision from the 2017 Tax Cuts and Jobs Act by enhancing federal tax incentives for state-level school choice legislation. Key provisions include doubling allowable tax-exempt 529 account distributions for qualified educational expenses up to $20,000 per year and offering gift tax exclusions up to $20,000 annually for contributions to these accounts.
States without qualifying school choice laws would see revoked tax-exempt status on municipal bonds used for local projects like new schools. In contrast, states adopting such laws would receive a 50% tax exemption on bond interest income or complete exemption if they fully embrace school choice.
The bill has garnered endorsements from various organizations:

Parents Defending Education Action noted growing parental awareness: “American students deserve to find educational options that work for them.”
Penny Nance from Concerned Women for America Legislative Action Committee remarked on income equality: “A family's income level shouldn't determine whether or not a child gets a good education.”
P. George Tryfiates from Association of Christian Schools International emphasized research supporting better outcomes through school choice.
Home School Legal Defense Association Action supports increased contribution limits benefiting homeschoolers.
Tarren Bragdon from Foundation for Government Accountability described it as "a monumental win" providing financial freedom for parents nationwide.
